Photography Client Agreement

This Photography Services Contract (the "Contract") is entered into between Bright & Gray Creative, owned by Jessica Morales (hereinafter referred to as the "Photographer"), and the client (hereinafter referred to as the "Client").

Services and Scope

The Client hereby engages the Photographer to provide photography services as outlined in the agreed-upon photography package. These services may include but are not limited to portrait sessions, event coverage, and other photographic services as mutually agreed upon.

Digital Photo Delivery

The Photographer will deliver the edited and finalized photographs to the Client in digital format via an online gallery. The Client will have the right to download, share, and print these photos for personal use. Depending on the package the Client has selected, the number of photographs they can download may be limited to a certain number. The Photographer will ensure that all downloaded photos are free of watermarks.

Editing & Retouching

All sessions include light editing, such as correction of stray hairs, color correction to match the Photographer's style, and other minor adjustments. However, the Photographer does not alter the way people look, including but not limited to the removal of large blemishes, changing facial expressions, altering hair styles, clothing, or body types. At Bright & Gray Creative, we believe in capturing who you are authentically in this season. We strive to ensure that everyone is photographed in flattering and fun lighting and poses, celebrating body positivity and natural beauty.

Payment

The Client agrees to make full payment of the agreed-upon photography package fee prior to the commencement of the photography session. Payment can be made via the payment methods specified by the Photographer.

Photographer's Usage Rights

The Client grants the Photographer the right to use the photographs from the session for business promotional purposes, both online and in print. This includes, but is not limited to, the Photographer's website, social media profiles, portfolios, marketing materials, and advertisements. The Photographer agrees not to use the photographs in any manner that would be deemed inappropriate or offensive.

Client's Usage Rights

The Client has the right to use the downloaded photographs for personal purposes, including sharing on social media, printing for personal use, and displaying the photographs in personal spaces. The Client agrees to not alter, edit, or otherwise change the photographs if posting publicly as the editing or changing of a photo could reflect on the Photographer. The Client also agrees to not post any screenshots of photographs that are not downloaded and paid for. Additionally, the Client agrees that any friends or family members with whom they share the gallery must also abide by these usage rights, ensuring that the photographs are used appropriately and without alteration.

Modification of Usage Rights

Any modification of the usage rights specified in this Contract must be agreed upon in writing by both the Photographer and the Client.

Cancellations and Rescheduling

The Client shall provide a minimum of 24 hours notice for cancellation of the photography session. If the Client fails to provide the required notice, they may be subject to a cancellation fee at the discretion of the Photographer. A full refund will be given if session is canceled within 30 days of the session time. A full session credit in the amount paid will be given if session is canceled within 7 days of session time. No refund will be given if canceled within 7 days of the session, however the Photographer will work to try to reschedule if the Client cancels due to illness or emergency before the 24 hour mark, or the Photographer may issue a partial session credit. The Photographer may not be able to reschedule if cancelation is after the 24 time frame.

In the event that the Photographer needs to cancel, arrangements will be made for rescheduling the session as soon as possible. If the Photographer has to cancel due to weather or other unforeseeable circumstances beyond her control, the session will be rescheduled at the earliest convenience for both parties.

Liability

The Photographer shall not be held liable for any injury, loss, or damage sustained by the Client or their associates during the photography session or as a result of the use of the photographs.

Governing Law

This Contract shall be governed by and construed in accordance with the laws of the State of Alabama, or wherever the session is taking place, without regard to its conflict of laws principles.

Terms of Signing

By paying the session fee, the Client acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Contract.
